Licensing

In accordance with paragraph 1 of Article 48 of the Law of the Republic of Kazakhstan "On licensing" license, and (or) an application for a license shall cease to apply in the case of exceptions a separate activity and (or) subspecies from the list of licensed activities.

Also in accordance with paragraph 2 of Article 48 of the Law of the Republic of Kazakhstan "On Licensing" at the termination of the license, and (or) application to the licensee (travel agent) shall, within ten working days to return the license and (or) a license application to the licensor (the Committee of the tourism industry MINT RC .)

According to Article 15 of the Law of the Republic of Kazakhstan "On the tourism activity," travel agent to engage in activities necessary to conclude the contract of obligatory insurance of civil liability of a travel agent and submit a copy of the insurance policy to the Committee of the tourism industry application form (with the obligatory indication of the BIN / IIN, TIN) on making information in the National Register of persons engaged in tourism activity (this registers readily approved by the Order of the Minister of Tourism and Sports of the Republic of Kazakhstan on October 23, 2008 N 01-08/180. Registered in the Ministry of Justice of the Republic of Kazakhstan October 30, 2008 № 5350).

However, the report that created the Kazakhstan Tourist Association of Travel Agents Registry One is voluntary and not binding.

In accordance with the Law of the Republic of Kazakhstan of July 15, 2011 № 461-IV «On introducing amendments and addenda to some legislative acts of the Republic of Kazakhstan on improvement of the permit system," state tourism agency activity license is canceled on 30 January 2012, that is, the tourist agency activity will be carried out without obtaining any license, the availability of state license is required only for tourist operator activity.

However, the travel agent shall, within five working days from the date of the (renewal) contract of obligatory insurance of civil liability of a travel agent to send to the Committee of Tourism Industry of the Ministry of Industry and Trade of the Republic of Kazakhstan application for entering information into the state register of persons carrying out tourist activities.

Travel agent promotes and sells only to tourists tourism product formed by the tour operator, established in accordance with the laws of the Republic of Kazakhstan.

Promotion and realization of tourist products travel agent made under an agency agreement for the implementation of the tourist product, concluded with a tour operator in writing.

Agency agreement for the implementation of the tourist product between the tour operator travel agent and must contain information about the tour operator, a developed tourist product on Contracts for the compulsory insurance of civil liability of the tour operator and travel agent, a description of the tourist route, accurate information about the tourist product.
